Summary of Client-Based Approach in Scotland

It has long been recognised that public bodies have an opportunity as "clients" procuring works and services to leverage a significant amount of training and employment opportunities. What has been missing is practical guidance and advice that addresses the procurement, legal and contractual issues and provides a simple framework for procuring public bodies, their contractors and the supply chains to respond effectively to this opportunity and set realistic and achievable benchmarks for outcomes.

This guide has been commissioned by ConstructionSkills to provide the working documentation for local authorities and other bodies procuring construction projects to embed employment and skills, right through from policy and strategies to procurement and operational implementation. It also explains how progress towards the outcomes can be monitored.

The guidance document includes:

  • Good practice information on use of an Employment and Skills Strategy and the development of an Employment and Skills Plan (ESP)

  • Legal, policy and process advice on procurement of contracts

  • Template benchmarks relating to a range of employment and skills areas

  • Guidance as to the inclusion of supply chain diversity

  • Appendices, including:

    • a template ESP

    • a summary of the employment and skills areas and potential issues surrounding them

    • template procurement and contract clauses

    • an Employment and Skills Strategy Workbook.

Contractor and Developer Guidance

ConstructionSkills commissioned this guide to assist contractors and developers to respond to the employment and skills requirements in clients' procurement documentation.

It includes:

  • what to expect from a procuring client's tender documents

  • the documents required to respond to such tenders

  • early contractor procurement and suggested methods of ensuring that employment and skills requirements are passed through the supply chain

  • template clauses for use in subcontracts

  • engagement with the client and supply chain during the pre-construction phase

  • ongoing monitoring of the employment and skills requirements.

Reference is made throughout this guide to its use by contractors, although it will apply equally to developers, whether they are undertaking works themselves or subcontracting to a main contractor.
