We are currently inviting tenders for Work Place Learning for the coming academic year’s contract, and would like to explain a little about the process, the role played by our personnel and also the potential consequences of failing to comply with the Government policy and procurement law.
CITB-Construction Skills is a Non Departmental Public Body (now referred to, since the formation of the new coalition government, as an “arms length body”). As such, we are required to follow Government policy and to comply in full with procurement law, including the Public Contracts Regulations 2006 (the ‘Regulations’). In addition, the body from which we receive the funding for the provision of Workplace Learning imposes on us certain conditions, including a requirement that we follow a competitive tendering process compliant with procurement law. If an appropriate process is not followed, funding could be withdrawn. It is therefore in the interests of all training providers that an open, fair and robust tendering procedure is followed.
CITB-ConstructionSkills will place an advert on our website inviting tenders for the 2011/2012 academic year. That advert will provide a contact name and email address from which you can request the tender documentation. All providers who contact us using that address will receive an identical pack of documents which will include an Invitation to Tender (‘ITT’) and Framework Agreement, together with confirmation of the timescale for submission. Tenders must be submitted by the date set out in the ITT.
Please note: no documents will be sent to you unless you request them from the contact named in the advert which will be placed on our website.
To ensure compliance with procurement law none of our personnel can assist or advise you in the completion of the tender documentation.
Fairness, honesty, effectiveness, professionalism and complete transparency are qualities that make up our core values and enable us to comply with procurement law. This shall be reflected in the behaviour of all of our staff. If CITB-Construction Skills staff were to be perceived in any way, as being involved with providing support or guidance to any training provider, other providers could perceive that provider to have been given an unfair advantage. This might lead to the disqualification of that provider from the process.
We hope, therefore, that you will understand that any staff unwillingness within the Contracts and Standards team to make any comment or offer assistance with the tender process is intended to protect your opportunity to tender and maintain our integrity, probity and fairness and should not be construed as a failure to offer you the guidance that you might be seeking. The ITT will set out a clear procedure for raising queries or requesting clarification on the tender documentation or the tender process.
We would recommend that all interested parties continue to monitor the CITB-ConstructionSkills website on a weekly basis and that, should they choose to tender at the appropriate time, they should ensure that every section of the tender document is completed in full.
